Definitions In these conditions, “Lessor” refers to RPM Hire. “Lessee” refers to the person or company named as customer on the face side of this document.

1. Receipt of Materials The Lessee acknowledges receiving the leased equipment in good condition.

2. Rental Period The rental period starts immediately upon the date of receipt or installation of the leased equipment and terminates on the return of the leased equipment to the Lessor’s premises.

3. Period of Hire – Minimum Rental The Hire will be deemed to have commenced from the time that the equipment leaves the Lessor’s premises to the time that the Lessor has been notified that the equipment has ceased working or has been returned to the Lessor’s premises. The rates are based on a minimum 8 hour day.

3.1 Cartage is chargeable on all hires where delivery is required. Collection charges will also apply if equipment is required to be collected. Equipment returned in an unclean condition will be charged a cleaning cost.

3.2 The Lessor reserves the right to change rates at any time without notification. Rates of equipment currently on hire will not change without notification.

4. Transport

  • All pricing is an estimate only unless otherwise stated in writing.
  • Fuel levy will be charged at cost.
  • Tolls will be charged at cost.
  • Hours are calculated depot to depot.
  • Minimum chargeable hours apply in accordance with the relevant contractor’s minimum engagement period.
  • Transport rates are based on the information provided at the time of quoting. Any changes to scope, access, timing, location, or requirements may result in revised charges.
  • Standard working hours are 7:00am to 3:00pm (Monday to Friday). Work outside these hours, including weekends and public holidays, will incur additional charges.
  • Demurrage will be charged in 30-minute increments at the quoted hourly rate where delays occur beyond RPM’s control.

5. Crane Services

  • All pricing is an estimate only unless otherwise stated in writing.
  • Fuel levy will be charged at cost.
  • Tolls will be charged at cost.
  • Site allowances (if applicable) will be charged at cost.
  • Meal allowances (if applicable) will be charged at cost.
  • Hours are calculated depot to depot.
  • Standard working hours are 7:00am to 3:00pm (Monday to Friday). Work outside these hours, including weekends and public holidays, will incur additional charges.
  • Inclement weather delays will be charged where applicable.
  • Minimum chargeable hours apply in accordance with the relevant contractor’s minimum engagement period.
  • Lay day, standby, or standdown time will be charged in accordance with contractor rates where applicable.

6. Onsite Labour

  • Meal allowances (if applicable) will be charged at cost.
  • Hours are calculated depot to depot.
  • Inclement weather delays will be charged where applicable.
  • Minimum chargeable hours apply in accordance with the relevant contractor’s minimum engagement period.
  • Absorbs / Water Filled Barriers: Client is responsible for filling and releasing water unless otherwise agreed in writing.
  • Absorb-M installation charge includes tools, consumables, chevrons, and labour only unless otherwise specified.
  • Where shift or travel times exceed standard limits, accommodation may be charged as an additional line item to safely manage worker fatigue.

7. Improper Usage and Permits The Lessee is responsible for obtaining all relevant permits that may be required in relation to the placement of the equipment. No claims will be accepted by the Lessor in any circumstances for any fines and other infringements incurred by the Lessee in the course of their hire, through failure to obtain these permissions.

For any fines or infringements incurred during the hiring of RPM Hire equipment, the fine or infringement will be passed on to the hiring company/individual Lessee. It will be up to hiring company/individual Lessee to delegate or re-nominate the fine as required and the Lessor takes no responsibility for renominating fines or infringements to any specific individuals on the Lessee’s behalf

8. Return of Materials Upon the expiration or sooner termination of this Agreement or upon the Lessor’s prior demand, whether reasonably given or not, the Lessee agrees to return all leased materials to the Lessor during the Lessor’s normal business hours within a reasonable period of time satisfactory to the Lessor.

8.1 Failure to return the leased equipment, and failure to return the leased equipment in a condition satisfactory to the Lessor, will cause the Lessee to be liable for such reasonable sums the Lessor states. In addition to any other liability the Lessee may have to the Lessor, the Lessee shall be liable for all losses including consequential losses, incurred as a consequence of the leased equipment not being returned within normal business hours of the Lessor. This clause in no way limits any liability the Lessee shall have to the Lessor.

9. Delivery, Pick Up, Installation and/or Removal Where the Lessee employs the services of the Lessor to deliver, install, pick up and/or remove the leased equipment, it is expressly agreed that this service is performed by the Lessor as the agent of the Lessee. The Lessee shall be liable for all damages or loss (including consequential loss) arising from any accident or act related to delivery, pick up, installation and/or removal, whether caused by the Lessee or any third party. This includes offloading, onloading and placement under overhead utilities, on property lines and/or landscaping.

10. Damage and Lost Materials Where the leased equipment are damaged, lost, stolen, destroyed or otherwise harmed, the Lessee agrees to pay fully for the repair or replacement cost of the equipment. Failure to pay this amount allows the Lessor to take recovery action.

11. Damaged Materials If materials are returned damaged, howsoever such damage occurred, the Lessor may repair them at its discretion and the Lessee shall reimburse the cost of repair.

11.1 Damage & Cleaning Charges

  • Broken or damaged concrete or steel barriers (rendering the barrier non-compliant) will be charged at full replacement cost plus 15% administration fee.
  • Graffiti cleaning will be charged at $300.00 per barrier.

12. RPM Hire Gold Equipment Protection (Damage Waiver) RPM Hire Gold Equipment Protection is offered at applicable rates for a selected range of equipment, provided RPM Hire is engaged for transportation and setup. Covered equipment includes Arrow Board Signs, CCTV Trailers, Evolis Radar Speed Signs, Light Towers, Portable Traffic Lights, Pedestrian Traffic Lights, Variable Message Signs and Variable Speed Limit Signals.

The following are excluded from the Damage Waiver: (a) misuse, abuse or overloading (b) contravention of this Hire Agreement (c) use in violation of laws or regulations (d) theft unless reasonably locked and secured (e) transport, relocation or installation by the Lessee or third parties (f) negligence of the customer or Lessee

Long term rentals are subject to annual CPI-based increases effective on each anniversary of the lease.

12.1 Where an exclusion applies, the Damage Waiver will not apply unless the Lessee establishes otherwise to the satisfaction of the Lessor and provides all requested information.

13. General Conditions

  • All pricing is an estimate only. Final invoicing will reflect actual hours worked, plant used, and applicable charges incurred.
  • Traffic Management for installation/placement and demobilisation is to be supplied by the Client unless otherwise quoted.
  • For night works, adequate site lighting must be provided by the Client unless otherwise agreed in writing.
  • Where anchoring is required, the Client must provide current service plans, permits, and Dial Before You Dig documentation prior to works commencing. If services are identified, a qualified surveyor must be engaged by the Client where required.
  • Any variation to scope, access conditions, staging, site constraints, delays, or programming may result in additional charges.
  • Increased duration of hire will be charged at the quoted hire rates.
  • Day loading and unloading at RPM Hire yard within standard working hours incurs no charge. Night shift or weekend loading/unloading incurs a Yard Management Fee of $2,000.00.
  • Works cancellation requires a minimum of 24 hours’ written notice prior to scheduled start time. Failure to provide notice will result in a minimum charge equivalent to one full day’s works at the quoted rates.
  • All prices exclude GST unless otherwise stated.
  • Quote validity is 7 days from the date issued.
  • All contracts and pricing agreements are subject to annual CPI-based increases

14. Disclaimer of Warranties The Lessor makes no warranties as to merchantability or fitness for purpose and accepts no responsibility for loss, damage or injury arising from use or failure of the equipment.

15. Liability The Lessee is liable for all damage, loss or injury arising from the leased equipment and agrees to hold the Lessor harmless from all related liabilities.

16. Indemnity The Lessee indemnifies the Lessor and its agents against all claims arising from use, storage, maintenance or transport of the equipment.

17. Title (a) Title remains with the Lessor and equipment may be retaken without notice if levied upon. (b) The Lessee authorises entry onto premises to inspect, repair or repossess equipment.

18. Subletting and Location The Lessee must not part with possession or relocate equipment without written consent and must store equipment safely.

19. Notice of Non-Waiver Failure to enforce any term does not waive the Lessor’s rights.

20. Retaking of Materials The Lessor may retake equipment without notice and the Lessee agrees to pay all associated costs.

21. Sub-Hire Where equipment is sub-hired, the owner’s conditions also apply.

22. Default On default, the Lessor may terminate the agreement, demand payment, retake equipment or pursue other remedies.

23. Payment Schedules All rentals are due immediately. Overdue amounts accrue interest at 2% per month. Legal recovery costs are payable by the Lessee.

The Lessee authorises credit card charges, undertakes to maintain sufficient funds and permits secure retention of card details until all amounts are paid.

24. Compliance with Installation Procedure The Lessee agrees to comply with the Installation Procedure Manual and, where handling equipment, confirms insurance, competency, risk management, WHS compliance and indemnifies RPM Hire Australia Pty Ltd.
